Solidarity actions in The Hague with comrade imprisoned in Spain on charges of expropriation

Last night we carried out actions in solidarity with our comrade who is imprisoned in total isolation in Spain on charges of participation in an expropriation in a bank in Aachen, Germany, two years ago. She is now awaiting extradition to Germany which will probably happen this week.


In solidarity we spray painted the texts ‘freedom for our Spanish comrade’ on a department of the Spanish embassy in The Hague, the Netherlands and glued the locks. In the morning during rush hour a banner was hung above the highway with the text: ‘Burn all prisons! Freedom for our Spanish comrade!’

We are not interested in knowing whether the comrade is actually responsible for the bank robberies or not. Expropriation is an ethically just and politically legitimate practice, a method of struggle that is part of the history of all revolutionary movements.

Indeed, despite the constant attempts by Power to reduce this method to within the scope of a ‘common crime’, motivated by individual greed, the fact is that the expropriation of places of accumulation of capital is a constant in our history: from the anarchist-syndicalist groups in the early twentieth century who robbed banks to support strikes or help the families of imprisoned comrades, to the various autonomous groups of the the 70s and 80s.

We call out to anybody to make action in solidarity with the comrade imprisoned in Madrid! Immediate freedom for the comrade!

Manifestation at Soto del Real prison [Madrid]

Chronicle of the manifestation at the prison of Soto del Real (Madrid), where the comrade arrested on the 13th of April is imprisoned.

Last weekend a group of comrades travelled to the Soto del Real prison in Madrid in order to break the isolation they want to impose on the anarchist that was arrested on the 13th of April, and to show the prison institution that neither she nor any imprisoned fighter is alone in front of the State. The manifestation, although we were not many, was a success; the comrade has told us she could hear the voice and noise of the people, effacing for a moment the silence they went to impose on her surroundings. A brief chronicle of the manifestation:

This Saturday, the 25th of June, some thirty people held a manifestation in front of the Soto del Real prison (Madrid) to show their rejection of imprisonment and of the extradition of the comrade arrested on the 13th of April, accused of the expropriation of a bank in Germany.

They shouted in solidarity with the prisoners and against penitentiary centres, they read a text in solidarity with the comrade and another in which the situation of imprisoned women was explained. At the same time, they lit fireworks, necessary to transgress the walls with noise and thus breaking the imposed distance between those inside and those outside.

During the manifestation some cops of the Guardia Civil appeared who asked for identification of the people present, which they refused. Despite this, the act ended with a repressive strike; the agents of authority stopped every car that headed for the exit, registering the cars and forcing identification.

Let’s not forget that this Thursday 30th of June the comrade will definitely be extradited and put at the disposition of the German authorities. All this, after having received numerous abuses by the direction of the penitentiary centre of Soto del Real, such as denying her the possibility of maintaining vis-a-vis communication with her partner on the day of her wedding or the prohibition concerning telephone contact with her and another person.

Retaliations against the comrade imprisoned in Madrid on accusation of robbing a bank

Since a few days, the anarchist comrade imprisoned in Soto del Real since the 13th of April has been the target of various abuses by the prison direction. Under the pretext of “security reasons” she has not only been denied the possibility of having vis-a-vis communication with her partner on the day of her wedding, but she has also been prohibited from having any telephone contact with her partner and one other person. Moreover, the assistant director of the prison has imposed on her different types of disciplinary measures for – according to him – “inciting mutiny” among the other prisoners in the isolation ward, and another measure as punishment for talking to other prisoners during the night.

We understand that all these punishments are retaliations for the comrade’s combative attitude and her solidarity; despite the distance and isolation she has continued to be determined in participating in the fights on the street, sending a message of support to the Banc Expropriat in Gràcia, and a card in which she reaffirmed her convictions and political practices of struggle against the State and the capitalist system.

From the point of view of us who are on the streets, all these attempts to silence and isolate her could only be thrown back through a multiplication of the manifestations of solidarity and efforts to diffuse and spread her words for which they want to punish her even more. Let’s also not forget that soon the deadline for her stay in the Soto del Real prison in Madrid will come to an end and it is expected that she will be extradited to Germany on June 30.

LAST MINUTE: The Audiencia Nacional has ordened the extradition of the comrade arrested on the 13th of April! Call out for MANIFESTATION!

The sadly famous – because reactionary –judge Ángela Murillo has ordened the extradition to Germany of the comrade imprisoned on the 13th of April, accused of having participated in the expropriation of a bank in the city of Aachen. The extradition could take place any moment within the next 10 days.

As you already know, the comrade was arrested last April during a policial macro-operation in which the social centre Los Blokes Fantasma and two other houses were raided and searched, because of an international order that was sent from Germany. The prosecution office of the city of Aachen ascribes to her the material authorship of a robbery that took place two years ago, of a bank that is connected to the catholic church, where a notable sum of money was taken without causing any personal harm. The prosecution office investigated this action within a supposed series of similar expropriations that happened the year before in this city. Within this investigation an anarchist comrade from Amsterdam has also been imprisoned, who is currently outside awaiting her courtcase after having spent several months in preventive arrest.

Despite having sent a call out for a manifestation on the day following the announcement of the extradition, but because of the struggle for the recuparation of the Expropriated Bank, we have decided to move the mobilisation to the coming week, next Tuesday the 1st of June, at 20h at Placa Diamant. These days of struggle, of resistance, of dignity in front of the brutality with which the police is defending the interests of the speculants, trying to abuse this space that is constructed for the neighbourhood, we feel the imprisoned comrade closer than ever. We know that she would be one more among many defending the Expropriated Bank with every means in the streets of Gracia, where she herself has lived for many years.

We do not know whether the comrade is responsible for the robbery that they ascribe to her, what we do know is that expropriation in the capital of the bank, whether it is in the form of money or buildings, will always be ethically just and politically legitimate. Which is why we send from here a call out to all the fighting people in solidarity of Barcelona and everywhere, to go out into the streets on the coming Tuesday 1st of June, to show that no matter how far they take her, our comrade will never be alone.

As many of you already know, the comrade who was imprisoned on the 13th of April, accused of having participated in the expropriation of a bank in the German city of Aachen could be extradited in the coming days. In the month that has passed since her imprisonment she has been locked up under isolation conditions in the Soto del Real prison in Madrid, but right now there are indications she could be handed over to the German authorities any moment.

Her extradition to Germany will imply creating a (even greater) distance between her and her loved ones, as well as forcing her into a penitentiary system that uses isolation extensively, making the communication of political prisoners (even more) difficult, toward the outside as well as with other prisoners.

Because of this we call out for mobilisation and struggle, a call out to not let this manoeuvre of collaboration between the European States against a fighting comrade happen without a response, showing that the attacks against her are also attacks against all of us that fight against the capitalist system and the misery it imposes with its logic.

Extradition to Germany postponed and letter from the comrade currently imprisoned in the Soto del Real Prison in Madrid, Spain on suspicion of a bank robbery in Aachen.

A few days ago, when we already took for granted the extradition of the comrade arrested on the 13th of April, we heard of the decision of the Spanish Audiencia Nacional to postpone by one month the handing over of her to the German State. This was a response to a demand made by our defence based on the process of marriage that the comrade was realising before she was arrested.

Precisely in the moment of hearing of the judicial decision, the comrade had been transferred to the women’s prison of Brieva (Ávila), from where we believed she would be prepared for her flight to Germany. Being there she managed to get this card to us, addressed to the outside, which we reproduce below. At the moment of writing the comrade is once again in the Soto del Real prison in Madrid, in isolation and sharing the yard with other prisoners, until at least the 30th of June, the date on which the extended period granted to enable the celebration of her wedding will end. Meanwhile, we call out to continue showing our solidarity with her in the streets, to show our support of all the imprisoned fighters, and our most profound contempt of the system that keeps them hostage to defend its miserable order.

Letter from the comrade:

Comrades, I write from the Brieva prison in Ávila, where they have just transferred me to after a month and a half in the Soto del Real prison in Madrid, always in FIES and isolation regime. I wanted to have written days ago, but all the communication and information is very slow and limited, and therefore I have not done it until now.

I deeply appreciate all the expressions and signs of solidarity and support. I have felt them so strong they transgressed the walls, the bars and the entire system of control and security. No matter how hard they try, they will never be able to break or brake our willpower and our decision to rebel against this world of complete misery in which they oblige us to live.

It is especially the more difficult conditions that give us more strength and determination to continue and sharpen the many fronts of combat we have, here inside as much as outside. The struggles for the liberation from every kind of oppression and authority are manifold, just like the just and legitimate methods and practices. From the simple negation of authority to the attack or the expropriation of a bank, there are many examples… The forever most important thing of the actions is that they can explain themselves and be understood for what they are; for their goals, finality and their value.

When the different struggles connect themselves in a wider context, they compliment and reinforce each other, and above everything break the division between the daily and personal with the political, since all the decisions we make in our personal lives end up being political, like the political decisions we take directly affect our personal lives. Although it is obvious we have to be careful with every step we take so as not to fall into the claws of the State and its servants, we know that struggling does not come for free, since the State and the media every time respond with more repression and a mediatic hunt toward all of us that face them.

For now I am here, but probably they will soon extradite me to Germany. I feel strong and alive, ready to face this situation and whatever is to come. More than anything proud of our ideas, our values and our anarchist practices and the life we choose now and that we continue to choose again every single day…

Update on Aachen repression

In July 2015 our friend and comrade got arrested at a passport control at the Greek-Bulgarian border. The Europe-wide arrest warrant against her had been issued by the prosecution office of Aachen, Germany, on the 24th of June 2015. In Germany she got locked up under the ‘U-haft‘ (Untersuchungshaft) regime in Cologne because of a presumed involvement in an armed bank robbery that had taken place two years earlier (2013). On the 2nd December 2015, after months of investigation the prosecution formally charged her with bank robbery, hostage taking and weapon possession. On the 16th of December, the court called the prison instructing them to release our comrade because all charges were to be dropped, since the “evidence” that months of investigation produced was not sufficient for this case to be brought to court.

When we were writing the above statement (1) concerning the imprisonment and release of our friend, we hoped it would be the last. Unfortunately the German cops did not agree, and decided to appeal against the decision of her release. This resulted in, after first being rejected by the normal court, the higher court’s decision to reopen the case. Concretely this means that, after having spent nearly six months in preventive prison, our friend and comrade is now outside awaiting trial. It is still unclear when the court case will take place. Despite several desperate attempts from the prosecutor’s office to also get a new warrant for her arrest – at the moment we are awaiting the high court’s decision of yet another appeal – she is still outside with us.

However, on Wednesday the 13th of April the same prosecutor’s office ordered a series of house raids in Barcelona that resulted in the arrest of another comrade; she is said to have participated in a bank robbery that was carried out in Aachen in 2014. It is clear that the German and Spanish authorities have decided to join forces in the ongoing project of repression against anarchists in the European territory, supported by the ever obedient dogs of the media.

As expected the media are rubbing their hands together, intertwining “common crimes” with anarchists. This does not come as a surprise, especially in a time that more and more is defined by repressive blows against anything subversive. However, we think it is important to leave the distinction between “common” or “political” crimes to the cops, the prosecutors, the journalists. We do not need to provide the authorities with categories they are only too willing too accept. As has been stated in the communiqué published by comrades of the person arrested in Barcelona, expropriation of banks is “an ethically just and politically legitimate practice, a method of struggle that forms part of the history of every revolutionary movement.” (2) Whether the accused individuals have participated in the robberies or not is not important to us. What is important is that we express our solidarity with those persecuted by the authorities.

While the servants of the State are spawning their assumptions and accusations into the world with a lot of spectacle, we should remember our own perspectives and ideas. These are not times for speculation, neither on the “motives” of the robberies, nor on the presumed innocence or guilt of the arrested. Rather than being a moment for questions, this should be a moment of answers – clear answers directed at those who oppress us. As has been said before, “you touch one of us, you touch all of us”. More than anything this is a time for solidarity, in every possible form it can take.

Communiqué about the last repressive operation in Barcelona and in solidarity with the comrade that is locked up in the prison of Soto del Real.

On Wednesday the 13th of April at five in the morning the Mossos d’Esquadra [Catalan autonomous police] began an operation in Barcelona in which they raided and searched two private addresses and one social centre in the neighbourhood of La Salut, “los Blokes Fantasma”, where the twenty inhabitants were held during twelve hours.

Besides the plundering and destruction that accompanies every police raid, the operation resulted in the arrest of a comrade who had already been imprisoned following Operation Pandora, and for whom there had been a European arrest warrant issued since the 11th of April based on the accusation of having participated in expropriations of banks in the German territory.

After passing in front of the Audiencia Nacional [Spanish special high court], judge Eloy Velasco sent our comrade to preventive arrest. She has been transferred to the prison of Soto del Real. Given that she is also facing charges in the Pandora process (currently in investigation phase) and that she has expressed the wish not be be extradited, our defence has requested a “condition” to the European extradition order, demanding that she will serve preventive arrest in Spain awaiting the court case that she has pending here. Within a period of maximum two months (extendible with one more month), the Audiencia Nacional will need to decide whether the handing over of our comrade to the German authorities will be temporarily suspended or not. From the news articles published in the German press we have learned that it concerns an expropriation that took place two years ago in the city of Aachen, during which – always according to the press – the group of assailants took a notable sum of money from the bank without causing any personal injuries or damage.

Whatever the outcome of the judicial process, we want to publicly show our support towards the comrade, vindicating as our own her revolutionary political goals, her struggle and her militant activity. Those who know her well know that she has truly deserved everyone’s solidarity. We are speaking of a person who is a fighter and an anarchist, who since years has been active in several anti-racist, feminist and libertarian projects in Barcelona, always in solidarity with the persecuted, always ready to help wherever she could, always ready to act, always generous, happy and smiling to those around her, always uncompromising and firm against everything that she perceives as unjust.

The attempt of the media to transform her into a public danger could not prove more perverse. Above all when this operation of mediatic manipulation implies presenting the banks as victims, in a total reversal of reality that dignifies those who have been robbing us, bleeding us dry, cheating us, dispossessing and cutting us down with impunity for years, while it criminalises those who rebel against its order and dare to attack it. We could not care less whether the comrade is actually responsible for the robberies or not. The expropriation of banks is an ethically just and politically legitimate practice, a method of struggle that forms part of the history of every revolutionary movement.

In fact, in spite of the constant attempts of Power to reduce this method in the scope of the “common crime”, motivated by personal interest and greed, what is certain is that the expropriation of places of accumulation of capital is constant in our history: from the anarchosyndicalist groups that at the beginning of the twentieth century robbed banks to maintain strikes or to help the families of the imprisoned comrades to the different autonomous groups of the ’70s and ’80s like the MIL, the OLLA or the Erate (formed by workers of the SEAT) that redirected the money accumulated by the rich to several projects of the exploited in struggle, to Maquis groups like those of Sabaté or Facerías that in the postwar period practised robberies in order to finance the resistance to the Francoist regime. Expropriation, both in its form as a tactical expression of a general political struggle and in the form of social banditism in which that what the banks are stealing from us is recuperated in order to free itself from the chains of exploitation of work and unemployment, to us does not seem something that is in principle reproachable – rather the contrary. That there are people that are sick of systematically being trampled under foot and exploited by the legal maffia confirms that “we are not commodities in the hands of the politicians and bankers” and that fortunately the human condition resists submissively accepting the dictatorship of capital over our lives.

The policial and mediatic hunt deployed because of the robberies in Germany should not let us forget our perspectives nor confuse us as to who are our enemies. The true public danger is power, represented by criminals such as Wolfgang Schäuble and Angela Merkel, the power that has not emptied a few heavy safes, but the social wealth of entire people and territories. It is the power of transnational elites that has pushed millions of people into misery in order to impose austerity measures that serve their neo-liberal and imperialist project. The arrest of our comrade is only another motive to fight these elites and the system they represent, a system only moved by the accumulation of money in the hands of a few at the expense of the suffering, dispossession and exploitation of everyone else. Neither the policial persecution nor the massive propaganda of the regime can hide what is already obvious to everyone, which is, as the poet said, what crime is robbing a bank compared to founding one?

Here is something we wrote about the arrest, detention and release of our friend and comrade.

Long months have passed since the hot summer day at the beginning of July when our friend and comrade got arrested at a passport control at the Greek-Bulgarian border. The Europe-wide arrest warrant against her had been issued by the prosecution office of Aachen, Germany, on the 24th of June 2015. After having spent three weeks in Bulgarian cells she got handed over to the German cops at the airport of Sofia.

In Germany she got locked up under the ‘U-haft‘ (Untersuchungshaft) regime in Cologne because of a presumed involvement in an armed bank robbery that had taken place two years earlier (2013). Under this regime prisoners awaiting trial are locked up, officially for a maximum of six months, which in reality very often is extended up to a period of over a year. In her case the restrictions put in place meant that at each visit (2 hours per month) there were two cops, a guard and a translator present, that she was not allowed to make any phone calls and that all post was first directed to the prosecutor’s office where it was read and then given to her after one month delay.

Her detention was based on a single piece of evidence: a DNA trace found on two gas pistols discovered in a closet of the bank by an employee 11 days later. A few weeks ago, on the 2nd December, after months of investigation the prosecution formally charged her with bank robbery, hostage taking and weapon possession. These charges were brought in front of three judges, who had to decide whether to pursue them in court or not. On the 16th of December, the court called the prison instructing them to release our comrade because all charges were to be dropped, since the “evidence” that five months of investigation produced was not sufficient for this case to be brought to court.

Now, our comrade is back with us. However, the joy that this brings us does not replace, nor lets us forget our anger towards the isolating restrictions, towards the ridiculousness of the uniform circus, and towards any authoritarian system that plays with people’s lives in such a way. The biggest source of strength came from the uncompromising and uncooperative stand our comrade took: she always kept her head up and her defiant spirits alive.

As most rebels and anarchists know, repression can hit us at any moment, because the State will go to very far extents to maintain its law and order and to prevent our ideas from spreading. In these moments it is easy to feel lured and trapped in a game of strategy and fear, the exact essence of our enemies.

In these moments we have to remember that we have other tools and practices to fight this asphyxiation. Only by facing their strategy with our own rebellious intelligence and grounded ethics, and fear with confidence in our complicities, affinities and struggles, can these moments become something more than just resigning ourselves to the technical and juridical aspects of the State imprisoning one of us.

Precisely in these moments of stress, anger and sadness it is crucial to not to let ourselves be intimidated or be tempted to doubt our ideas, our relationships and our struggles. Although keeping our feet on the ground, our mind sharp and our heart burning can be challenging during these moments, we are the ones who let them take from us much more than the freedom of a comrade, we are the only ones who can fight against their logics nesting inside of us.

Our ideas and struggles are forged in the hatred against prisons and the world that needs them. The fight against these structures and those who make them possible involves to express and extend our desire to open all their doors and destroy these pillars of this authoritarian and capitalist society. Confronted with any repressive attack it is crucial to not forget these ideas, nor to put them aside; we can only build a perspective through active solidarity, in the continuation of our projects of struggle against all the manifestations of this prison-society.

We agree with the words of our comrade and refuse to speak in terms of ‘innocence’ and ‘guilt’. These words belong to the language of prosecutors and judges in service of politicians and bosses. Words that support their system of exploitation and control. As anarchists it is a language we refuse to speak, we spit on it.
The reason we did not and are not publishing her name is to not fuel the often distracting and distorted role of hero or victim that anarchist prisoners are sometimes subjected to. She was an imprisoned anarchist comrade among many others, who will neither be forgotten nor exulted, but who are present in the continuation of our struggles and projects and in our acts of subversion towards this established order.

A few days ago in Italian prisons commenced the collection of samples destined to compose the National Archive for DNA, an institution run under the Minister of Internal Affairs who is busy compiling the genetic profile of all the individuals incarcerated, investigated, arrested or detained, along with the Dna found on crime scenes. This process is in accordance with a decision taken on a European level – sanctioned in 2005 by the treaty of Prüm, endorsed by Germany, France, Belgium, Spain, Luxemburg, the Netherlands and Austria (and adopted by Italy in 2009) – as part of the the so-called “fight against terrorism and criminality”, which also extends beyond the European Union’s borders. Now, officially and with a few years of delay, the italian authorities have started to put into practice a measure which has already been implemented since years in other countries. In the United Kingdom, the homeland of the inventor of the genetic print, Alec Jeffreys, the National Dna Database was already instituted back in 1995. Also France certainly did not wait for the Treaty of Prüm to create its very own Fichier national automatisé des eimpreints génétiques, founded in 1998.

Genetic profiling is described by all governments as a “powerful weapon in the fight against crime”, capable of providing key elements to punish the perpetrators of particularly heinous crimes and of exonerating the innocent. Especially evoked in the cases of homicide and rape, Dna as a piece of evidence, is presented as if it were definitive, irrefutable, synonym of absolute truth. Today the british archive as well as the french one contain millions and millions of genetic codes and their number is constantly increasing. All potential killer rapists? Certainly not. As a crossroads between a “justice equal for all” and a “science at the service of all”, the taking of Dna samples is a judicial procedure which possesses the same exponential and irreversible qualities of technique. Exactly like justice and science, it is functional only to the interests of the State. Thus, in countries like the cunning Albion the taking of a DNA sample is intended not only to solve particularly brutal cases, but also against those accused of shoplifting or of public drunkenness or of participation in a non-authorized demonstration (to give an idea of the generalization of such a practice, it suffices to mention that already by the end of 2007 the british database contained the data of 150.000 kids under the age of 16); while in the land of human rights the field of genetic collection, originally proposed to unmask a serial killer, has been extended over the course of the last years in order to uncover, among other abhorring crimes, the authours of graffiti and saboteurs of Gmo cultivations.

All of this could pose some scruples to some noble democratic consciences, who could remain vexed before the quite totalitarian idea that a State should proceed with the classification of the genes of millions of its citizens and that according to its discretion would sift through its database on the occasion of each infraction of its penal code, basically turning everyone into potential criminals. To quell their indignanated souls, they propose and expect some limits to Dna screening and to its use, limits which clash both with the security promises of such a procedure and with its own scientific qualities. The punitive efficiency and the dissuasive one of a Dna match are in fact both inherent to an initial prerequisite: the Dna has to already be present in the archive. It is in fact completely useless to posses the Dna of a homicidal rapist if there is no Dna with which to match it. The more Dna samples are collected, the more likely it is to find the perpetrator (punitive efficiency). The more Dna samples are stored the more probability of crimes diminishing (dissuasive efficiency). To genetically profile an entire population would therefore be an ideal perspective from a securitarian point of view, because it would at the same time guarantee the highest preventive measures and the highest level of repression. Remember, the State knows you, knows everything about you, and therefore…don’t be afraid, and just don’t do bad things. Why would this ever arise ethical doubts for those who accept securitarian logics? Because those who invoke security cameras everywhere and have nothing against phone tapping, nor against the taking of fingerprints, why would they worry about an eventual genetic screening? If Dna doesn’t lie as scientists swear, if its test is a scientific procedure that works what can then be the problem? There is no problem, in fact it seems that the first ones who ever supported the necessity of profiling all citizens were some arab countries, whose governments notoriously take to heart the triumph of truth and justice. Or maybe, perhaps, some small problem in this whole affair is still lingering. In fact the father of the genetic print on one hand proposed the profiling of the entire population, on the other hand was keen on pointing out that the data should not be preserved by the State, but rather by a “neutral” institution.

Ridiculous scruples. It is not at all difficult to understand where the problem lies, nor its dimensions. Let’s even leave behind for now the technical disputes over Dna samples, on how long it should actually be in order to be reliable or about how long it should be stored in order to preserve the “right to privacy”. And forget the hypothetical future scenarios, such as: what would happen if this data fell into the wrong hands…? This is not the point. This data is already falling into the hands of someone, who is collecting them. And why? To protect us from sex maniacs and blood thirsty killers? That Dna doesn’t lie is already not a certainty. But the State that uses it, certainly does lie! In the end, it is not even necessary to rig the answer, when it is possible to rig the question.

But let’s even start from the answer, the one of Dna. Lawyers and scientist agree on presenting it as if it were a supreme proof, indisputable. Because deoxyribonucleic acid is a macromolecule present in the cells of all living organisms, responsible for the transmission and the expression of hereditary traits, as they say, unique, different from individual to individual, the Dna of a spit will automatically spit out the Truth.

Now, even though the media always talk generically about Dna evidence, it is necessary to know that there exist two types: the nuclear one and the mitochondrial one. Nuclear Dna derives half from the father and half from the mother, it is the more precise and discriminating one, it is present in “live cells”, such as saliva, blood, sperm, hair follicles. However, it has a defect: as soon as it detaches itself from the body, it deteriorates quite easily. Often by the time it arrives to the laboratory it is no longer usable. The mitochondrial Dna, instead is transmitted through the lineage of the mother, and it is quite less precise (it can be shared by people that don’t belong to the same family as it can vary between family members) and it can be found also in “dead cells”, such as skin flakes. This is why it lasts longer.

From a trace of Dna, from a tiny piece of the human body, a “profile” is obtained, in other words a series of data which correspond to a part of the Dna of the individual. It is not the entire Dna sequence, but only a part of it, the one chosen by the experts. The Dna profile is therefore obtained by the analysis of some of the points of the entire Dna sequence. Once this profile is obtained, the authorities search for some correspondences, similarities among those present in their archives. Then, following their procedure, the result can never be the absolute truth, but only an approximation based on a probability calculation. This is not the same thing. Already it is an hypothesis that the Dna of 7 billion people is different in each individual (have all of them been examined and compared?); then taking into consideration that only a small part is actually analyzed (found where? how long? and after how much time? these parametres vary from country to country, from epoch to epoch); then subjected to other possible external contaminations, how can it be affirmed that the answer is peremptorily precise?

The most recent case, and for us the closest and best known, is the one about the murder of a 13 year old girl near Bergamo, which took place in 2010. In order to find the culprit, the Dna of 18.000 people was taken, basically all the inhabitants of the region (which offered themselves voluntarily). The presumed perpetrator was arrested precisely based on a Dna match. His Dna wsa found on the underwear of the young girl. But, wait, there was found no trace of his mitochondrial Dna! This fact was deemed inexplicable by the same experts. Could this be the reason why the prosecutors fabricated a video which showed the defendant’s van on the scene of the kidnapping of the girl? Would this be the incontestable, indisputable truth for which more than 3 million Euros were spent?

Several similar cases have occurred. In England in 2000 a man struck by Parkinson’s disease was arrested for a robbery committed 300 km away. Having already been arrested for a quarrel with his daughter, the police had taken his Dna, which matched the one found on the crime scene. The lawyer demanded that a longer strand of Dna be examined, and the result turned out negative. In France in 2004 the husband of a woman murdered two years before was arrested, because on the body they had found a hair whose mitochondrial Dna matched the one of the man. After different months of pre-arrest and of probation, the man was released when the comparison with the archive of genetic profiles gave an unexpected result: his Dna sample matched also an other profile, the one of a convict who had deceased some time earlier.

It is therefore not a chance that some prefer to talk about “compatibility” of Dna. The profiles don’t correspond, they can at most be considered “compatible”. What does this mean? That the supreme incriminating evidence, which should demonstrate the (penal) responsibility of a human being, enough to warrant a sentence and a subsequent reclusion, is that a part of the Dna of the defendant is apparently compatible with a part of the Dna found on the crime scene, and therefore probably attributable to the culprit. Factual truth or rather rough hypothesis?

To this can be mentioned the problem of human errors and contaminations, both during the course of the crime scene forensic sampling and during the analysis. Switching of labels, of test tubes, mixing up of organic tissues. The same Alec Jeffreys admits that the widening of a genetic archive, as much as he deems it essential, will certainly increase the numbers of mistakes: “created and maintained by human beings, it will undoubtedly have mistakes, it’s mathematical”. In fact in the United States in 2002 a man was condemned to 12 years of prison for a rape and he was released after four and a half years of detention. It turned out that the Dna discovered by the police belonged to two different people, excluding the fact that he could have been involved. It ended up being a mistake committed in the forensic laboratory, which was subsequently shut down because of its unreliability. The prosecution then opened an investigation in order to verify the accuracy of 25 sentences, 7 of which capital punishments. Even more hilarious is the story of the “woman without a face”, considered by the media “the worst serial killer that Europe has ever known”, who apparently committed her first murder in 1993 in Germany. Over the course of the years her Dna had been found on the crime scene of different murders and robberies, around twenty in total, spread out over half of Europe (Germany, France, Austria). Unpredictable, elusive, nobody had ever seen her, but she seemed to leave her genetic print everywhere. Against her unleashed a mighty woman-hunt: thousands of witness statements, intense interrogations against her presumed accomplices, 12 million Euros spent over the course of the investigations and a price on her head of 100.000 Euros. Thousands of Dna samples were taken from women in the south of Germany, France, Belgium, and even Italy. Finally in 2009, the “woman without a face” was identified, nailed for her role in this whole story. The irrefutable truth came out: the Dna was of a worker for the company who provided to many of the european police services the swabs used to take the genetic samples from the crime scenes!

As we have seen, the answer that Dna gives is not exactly synonym with truth. But there’s more: it is the question itself which is false. Because even if the Dna evidence were to be authentic, even though the entire sequence of the Dna of a person were to be analyzed and would perfectly match the complete sequence found on a crime scene, what would this prove? Nothing, it would still not be a proof of guilt. The Dna found on a bottle thrown against a line of cops during a manifestation does not necessarily mean that it belongs to the individual who threw it. It could be the Dna of somebody who packaged it, or who sold it, or who bought it, or who opened it, or who drank it, or who passed it on, or who threw it away… The Dna found on the scene of a crime does not necessarily correspond to the one of the culprit, it could very well be the one of someone else. Furthermore, the presence of Dna does not even demonstrate the actual presence on the crime scene of the person considered a match. Each human being, on a daily basis loses hair from all parts of their body, talks and spits, eats and drinks, pisses and shits, can also scratch, bleed or smoke. He leaves traces of his Dna in all kinds of places, on many objects, on countless people. Leaves traces and picks others up, also moving them elsewhere. Shoes, for example, how many traces of Dna could they pick up and transport? Therefore, to claim the guilt of someone based on the fact that their Dna was found on the scene of a crime is absurd.

There was a time in which the same men of law would insist that a snitch could not even enter a court room. His word could not constitute an element of proof, it could only provide the investigators a path which still needed to be demonstrated. If his indiscretions could be upheld by concrete evidence, these were the elements that could be admitted. His word in itself, would not count for anything. From this point of view the discovery of Dna on a crime scene, even though it would be the matching one of the suspect, would be even less reliable. The snitch says who he thinks is (in his opinion, interest, memory and knowledge) the responsible one for a crime. Dna says who is (perhaps, probably, and in some cases certainly) the responsible for a crime.

But since justice is blind, to be able to see, it tends to trust in others. In human beings, for example, even when they are as disgusting as snitches. In fact today the word of two “collaborators” is enough to condemn someone. Let alone then if justice would not trust even more and more willingly in the microscope of science, who since always has the bad habit of presenting its hypotheses as irreproachable truths. “It’s true, it’s scientifically proven, science says so.” Instead history shows again and again that a scientific hypothesis, presented as absolute truth in a certain era, could be considered false some time later. Scientific discoveries are presented as certainties, but rarely are. In fact, each scientific theory is based on a representation which is determined by an ideology. Biological sciences interpret living organisms as if they were a machine that responds to the command of a program composed by genes. This approach, which reduces and compares the human being to a computer, is not at all the result of observations. On the contrary, it is what determines them. It is not the observation of life to suggest the existence of a program, it is the mechanistic vision which ensures that life be observed in this particular way. Scientists begin from an a priori, and then go searching for the confirmation of their thesis (“man is a machine, let’s look for its gears!”).

In the current world, science is considered a synonym of truth. This pushes almost anyone to use apparently scientific arguments to give himself legitimacy. What is true is what those qualified say, what the experts say. Everyone follows this logic, from the cops to the prosecutors, from militants to activists, without even having to mention normal people. The expert, is someone who knows. His opinion is “objective”, it melts away all doubts. An expert is a pusher of truth.

The State, who loves to pass itself off as a guarantor of the common good where in fact it serves only the interest of the few, administrates a Justice which it claims being the same for the usual everyone but that is made by laws written and applied by the usual few. The State, like its Justice, are obviously biased, but have a desperate need to appear neutral, objective, above all parties. This is why they use science. When Lambroso would measure the cranium to identify thieves and assassins, when Hitler measure noses to discover Jews, what were they doing so differently than who today consults biology to make Justice triumph? Today Dna evidence represents the magical answer to the anguish of the judicial mistake, the only nightmare that can occasionally keep awake the butchers in black coats and wigs. And once immersed in the test tubes of the laboratory, Justice can finally appear perfect, as precise as a computer.

Except that there are many experts and that most of the time they have contradicting opinions. This is because science cannot assert absolute truths, it can only offer hypotheses. We are thus before the following paradox: no “scientific truth” can be considered a certainty, however today everything that a society wants to deem a certainty cannot avoid using scientific arguments. What instead is certain, indisputable, terrifying, is unfortunately something else. The governments of many countries are screening millions of people, using arguments which pre-announce a total screening and profiling.

Those who hold power, political or even just economic, will have access to the most intimate data of each one of us and will be able to do with it anything they want. It is not necessary to venture off into science-fiction scenarios, it is enough to look at what has already happened only yesterday to sense what is going to come tomorrow. Someone remembers the molotov cocktails “found” in the courtyard of the Diaz school in Genova in July 2001, just after the slaughter perpetrated by the police? There you have it, from now on to eliminate the undesirable, the authorities will no longer even have to construct special investigations, instruct false informers, fabricate false evidence. No, it will be enough to let something as imperceptible as a drop of saliva, a hair, a cigarette butt – belonging to those to eliminate – be found on the next crime scene.

Within this world, of this social order, human beings drag on a dull existence, voided of beauty and passion, immersed in anguish and desperation, in a daily search for crumbs of survival. The ill of living provokes everywhere conflicts, acts of violence. The State intervenes to limit the effects for which it is the main cause. It presumes to impose punishments decreed by laws created to protect itself. And to identify the authours of these acts of violence it relies on the hypotheses of science, which are pushed as truths. The circle is closed in the coherence of abjection. A vile State applies a blind justice through a manipulable and manipulative science; all of this presented as an example of virtue.

There you have it, the world in a spit.
